Indiana ACEP Aims to Strengthen Prudent Layperson Standard Enforcement

Indiana ACEP is refusing to tolerate insurer bad behavior. The chapter was instrumental in the drafting and introduction of a new state senate bill that would reinforce the prudent layperson standard and help make sure that insurance companies fairly and promptly reimburse emergency physicians for care.

Senate Bill 242 would block insurers from denying claims solely because they are not on a list of services maintained by the state. This legislation is particularly beneficial for smaller, independent practices that often lack the resources to stand up against massive insurance companies.

"INACEP has been working toward ensuring fair reimbursement for emergency physicians for several years,” said Emily Fitz, MD, FACEP, president of INACEP. “We see this legislation as a step in the right direction. It is our hope that our state legislature supports us and passes this bill so that Indiana continues to lead the nation in its support of emergency physicians and the patients for whom we provide care.”

ACEP chapters drive momentum for changes that matter. Indiana ACEP is also the engine behind legislative language supporting physician-led emergency care.

The model developed by the Indiana chapter has become state law in Virginia and ACEP chapters are using it as a model to introduce state legislation across the country.
